Alpha91 Complete License Agreement
1. Introduction
This License Agreement (“Agreement”) is a legal agreement between you (“User”) and Alpha91 Enterprises (Pty) Ltd (“Alpha91”) governing the use of Alpha91 hardware, firmware, software, and related services (collectively, the “Alpha91 System”). By using or purchasing Alpha91 Products, you agree to comply with this Agreement.
2. License Types
2.1 Personal Use License (Free)
Alpha91 grants a non-exclusive, non-transferable, revocable license to use the Alpha91 System for personal, non-commercial purposes.
Permitted:
- Use Alpha91 base firmware and hardware for personal projects.
- Modify and experiment with base functionality for personal use.
Not Permitted:
- Commercial use, resale, or distribution of Alpha91 Products.
- Access to BOM files, 3D CAD files, or premium cloud APIs.
- Removal or modification of Alpha91 branding (logos, names, or identification labels).
2.2 Commercial Use License (Paid)
For any commercial use, including manufacturing, distribution, or resale of Alpha91 Products, you must obtain a Commercial License from Alpha91 Enterprises (Pty) Ltd.
Commercial License Includes:
- Access to advanced features, including:
- Premium cloud APIs and data logging.
- Bill of Materials (BOM) certified by JLCPCB.
- 3D CAD files and manufacturing details.
- Permission to manufacture, resell, or distribute Alpha91 systems.
- Fixed Yearly Fee: A yearly fee applies to the commercial license. This fee is fixed regardless of cloud usage and includes all hosting costs.
- Unlimited Devices: There are no limits on the number of devices under the commercial license.
- No Monthly Commitments: The fixed annual fee covers all costs, and there are no additional monthly commitments for hosting or services.
Commercial License Restrictions:
- The Alpha91 name and logo must remain intact, visible, and unaltered on all products and components.
- Redistribution, sharing, or sublicensing of BOM, CAD files, or cloud API credentials is strictly prohibited.
- Unauthorized commercial use will result in immediate termination of this Agreement and enforcement actions.
3. Branding and Trademark Policy
The Alpha91 name, logo, and trademarks are the property of Alpha91 Enterprises (Pty) Ltd.
- Removing, modifying, or replacing Alpha91 branding on any components or products is strictly prohibited.
- Violating this policy may result in termination of licenses and legal action under trademark laws.
4. Restrictions on Use
By using Alpha91 Products, you agree not to:
- Modify, disassemble, or reverse-engineer proprietary Alpha91 firmware, hardware, or cloud systems.
- Use Alpha91 Products for illegal purposes.
- Circumvent licensing mechanisms or restrictions in the Alpha91 System.
- Share, sublicense, or distribute BOM files, 3D CAD files, or premium cloud API credentials.
- Remove Alpha91 branding from any Alpha91 hardware or components.
5. Ownership
Alpha91 Enterprises (Pty) Ltd retains all rights, title, and interest in and to the Alpha91 System, including hardware, firmware, software, designs, and documentation. The Alpha91 name, logo, and branding are protected under applicable trademark laws.
6. Purchase Options
Alpha91 Products and Commercial Licenses are available for purchase:
- Through the Alpha91 Shop at https://shop.alpha91.co.za.
- Fully assembled systems are available for users who do not wish to order components from JLCPCB.
7. Updates and Support
- Alpha91 may provide firmware updates or software improvements. Updates may include bug fixes, new features, or security enhancements.
- Support and updates are available to licensed users.
8. Data Privacy and Security
Alpha91 prioritizes data security:
- Cloud communication occurs over secure HTTPS/TLS connections.
- Alpha91 does not collect personal data unless explicitly required for cloud functionality (e.g., API keys).
- Logs and system performance data are stored securely for analysis and reporting.

9. Termination
Alpha91 may terminate this Agreement if you violate its terms. Upon termination:
- You must cease using all Alpha91 firmware, software, and related services.
- Unauthorized commercial use will be enforced under applicable laws.
10. Warranty Disclaimer
Alpha91 Products are provided “as is” without warranties of any kind. Alpha91 does not guarantee:
- Error-free or uninterrupted operation of the Products.
- Compatibility with unauthorized third-party systems.
11. Limitation of Liability
To the maximum extent permitted by law, Alpha91 Enterprises (Pty) Ltd is not liable for:
- Direct, indirect, incidental, or consequential damages.
- Loss of profits, data, or business interruptions arising from the use of Alpha91 Products.
